Overview
Robust mergers and acquisitions (M&A) activity continues in the federal contractor space. Much of it involves small business contractors whose size and/or status are determined at the time of initial offer. Presently, small businesses generally retain the ability to compete for set-aside work throughout the life of a government contract (including any orders thereunder), even if the small business is merged or acquired. But the Small Business Administration (SBA) issued a proposed rule that could significantly change the effect of recertifications following a merger or acquisition of a small business contractor. This event will address the potential implications of the SBA’s proposed rule.
